Welcome to Genki Superfoods ("Genki", "we", "us" or "our"). These Terms of Service ("Terms") apply to your use of www.genkisuperfoods.com and any purchase you make from us (together, the "Services"). By using the Services or placing an order, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.
1. Eligibility and your account
You must be at least 18 years old, or the age of majority where you live, to purchase from us. You agree to give accurate, current information when you place an order or create an account, and you're responsible for keeping your account login secure.
2. No medical advice
Genki products are dietary supplements. They are not intended to diagnose, treat, cure or prevent any disease. Statements on our website and in our marketing have not been evaluated by the Food and Drug Administration.
Everything on the Services, including product descriptions, articles, FAQs, and customer reviews, is for general information only and is not medical advice. Always talk to your doctor or another qualified healthcare provider before starting any supplement, especially if you are pregnant or nursing, under 18, take prescription medication (including blood thinners, anti-platelet drugs or daily aspirin), have a bleeding disorder, or have surgery scheduled. 3. Products and product information
We work to describe our products accurately, including ingredients and serving information. Product packaging and labels may be updated over time; always read the label on the product you receive before use. Colors and images may look slightly different on your screen. We may change or discontinue any product at any time.
4. Orders, pricing and payment
When you place an order, you're making an offer to buy. We may accept or decline any order, limit quantities, or cancel an order (for example, because of a pricing error, suspected fraud or a stock issue). If we cancel an order you've paid for, we'll refund you in full.
Prices, discounts and promotions may change at any time, but the price you pay is the price shown when you place your order. Prices don't include taxes and shipping unless stated at checkout. You agree that the payment information you give us is accurate and that you're authorized to use it.
5. Subscriptions
If you choose Subscribe & Save, your order renews automatically at the frequency and price shown at checkout until you cancel. You can cancel at any time from your account (Manage Subscription) or by emailing us. Full details, including billing and cancellation timing, are in our Cancellation Policy.
6. Shipping
Delivery times are estimates and aren't guaranteed. Risk of loss passes to you once your order is delivered to the carrier, but we'll help if a package is lost or damaged as described in our Shipping Policy.
7. 60-day money-back guarantee and returns
Your purchases are covered by our 60-day money-back guarantee and are subject to our Refund Policy, which explains how to request a refund and return your product.
8. Reviews and other submissions
If you submit a review, photo, comment or other content, you confirm that it's truthful, reflects your own experience, and that you have the right to share it. You give us a non-exclusive, royalty-free, worldwide license to use, reproduce and display it in connection with the Services and our marketing. We won't edit the meaning of a review. We may remove submissions that are unlawful, misleading, offensive, or that make medical claims. If you received anything of value in exchange for a review, you must disclose it.
9. Intellectual property
The Services and their content, including the Genki name and logo, text, images, graphics and design, belong to Genki or its licensors and are protected by law. You may use the Services for your personal, non-commercial use only. You may not copy, reproduce, distribute or create derivative works from our content without our written permission.
10. Prohibited uses
You agree not to use the Services for any unlawful purpose; to buy products for commercial resale without our permission; to interfere with the security or operation of the Services; to scrape or collect data from the Services; or to submit false or misleading information.
11. Third-party links and tools
The Services may include links to, or tools provided by, third parties. We're not responsible for third-party websites, products or services, and your use of them is at your own risk and subject to their terms.
12. Relationship with Shopify
Genki is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Genki. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Genki, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Genki.
13. Disclaimer of warranties
EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY LAW, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ANY PRODUCT WILL PRODUCE ANY PARTICULAR RESULT. SOME JURISDICTIONS DON'T ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, GENKI AND ITS OWNERS, EMPLOYEES, AGENTS, SUPPLIERS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
15. Indemnification
You agree to indemnify and hold harmless Genki, Shopify and their affiliates from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your violation of any law or the rights of a third party.
16. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, except where the law of your place of residence requires otherwise.
17. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date, and will apply to orders placed after that date.
18. Severability and entire agreement
If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy and Cancellation Policy, are the entire agreement between you and Genki about the Services.
